A Presidential Pardon in the Republic of Yemen is a formal act of executive clemency granted by the Office of the Presidency, acting through the Presidential Committee for Pardons & Clemency, under the authority of Article 125 of the Constitution of the Republic of Yemen and in accordance with Yemen Clemency Decree No. 47 of 2022. A pardon extinguishes custodial sentences and associated penal encumbrances, releasing the Pardonee from the grip of state punishment — though civil liabilities, such as outstanding debts, remain independently enforceable.
Pardons are issued under Article 125 of the Yemeni Constitution and governed by Clemency Decree No. 47/2022. The Presidential Pardon Committee reviews each petition thoroughly before any pardon is granted, in consultation with the Ministry of Justice, the judiciary, and the Ministry of Interior.
Pardons are granted in the interests of justice, humanitarian considerations, diplomatic relations, or when the circumstances of the original conviction warrant clemency. They reflect the sovereign right of the State to show mercy and enable rehabilitation, especially for foreign nationals or in cases where continued imprisonment serves no further public interest.
Foreign nationals granted a Presidential Pardon in Yemen are entitled to consular notification of their home country's embassy, return of travel documents and personal effects, and facilitation of repatriation through diplomatic channels — subject to satisfactory completion of all conditions attached to the pardon.
Every pardon in Yemen is accompanied by three official instruments: the Presidential Pardon Certificate (issued by the Pardon Committee), the Pardon & Release Permit (issued by the Ministry of Interior), and the Official Registry Printout (maintained by the Office of the Attorney General). All three carry equal legal weight when presented with official seals.
A Presidential Pardon extinguishes penal and custodial consequences only. Any outstanding civil obligations — including financial debts, commercial liabilities, or compensation orders — are expressly not discharged by a pardon and remain fully enforceable through civil courts, independently of and subsequent to the pardon.
A pardon does not take automatic effect upon issuance. It becomes fully active and enforceable only when all stipulated conditions and administrative requirements have been satisfactorily completed and confirmed by the issuing authority. Until that point, the pardon remains in a state of pending activation.

Pardons are conditional. Obligations — financial and otherwise — survive the pardon and remain enforceable under Yemeni civil law.
Foreign embassies are formally notified upon pardon registration. The system operates in coordination with international diplomatic channels.
A Presidential Pardon is not absolute and irrevocable from the moment of issuance. The Republic of Yemen reserves the right to revoke or suspend a pardon where the Pardonee fails to meet the conditions attached to it, or where circumstances arise that warrant the withdrawal of clemency.
